Temporary total disability - the ongoing saga of the voluntary abandonment doctrine

In State ex rel. Quest Diagnostics, Inc. v. Indus. Comm. | 2022-Ohio-1093 | 10th Appellate District | Decided: Mar 31, 2022 a petition for a writ of mandamus to compel the industrial commission to vacate an order granting claimant's temporary total disability compensation is granted.  The court reasoned that the injured wokrker resigned her position for reasons which were not causally related to her workplace injuries. The court held that according to factual determinations made by the Industrial Commission, that claimant was ineligible for disability compensation under legal analysis required by Klein, and although claimant may have felt forced to resign her position due to circumstances, none of the circumstances were related to her injury.
